In the event that the advertisement suffers from a formal defect, it will be returned by the BOE. The reason for the return will be received back in the management environment of the submission to EACAT and the BOE will send a warning message by email to the address reported in the form for creating a new announcement (see point 14 of the FAQ ) in which the reason for the return is explained, among which the following should be noted:
- That it is not a notification ad.
- Use of Catalan or Aranese in the mandatory text block in Spanish (see point 7 of the FAQ ). There is a co-official content field reserved for this purpose (see points 8 and 9 of the FAQ ).
- Use of Catalan or Aranese in the notification file (see point 13 of the FAQ )
- Repeat the words anuncio , notification and/or procedure in the procedure field and, in turn, in the title of the announcement (see points 1 and 5 of the FAQ ).
- Use capital letters that are not grammatically required in the procedure field and, conversely, in the title of the ad (see points 1 and 5 of the FAQ ).
- Manually include the name of the entity in the procedure field and, in turn, in the title of the announcement (see points 1 and 5 of the FAQ ).
- Do not expressly include in the text to be published a reference to the provision that enables publication in the TEU (article 59.5 of Law 30/1992, of November 26, of the Legal Framework of Public Administrations and Common Administrative Procedures, article 112 of Law 58/2003, of December 17, General Taxation, or equivalent precept) and in the event of concurrent fact ( unknown interested parties, ignorance of the location or medium of notification, unsuccessful notification attempt ); for example " De conformación con el artículo...hadiendo sin efecto personal notification ..." (see point 7 of the FAQ ).
- Include more than 5 notifications in the content field in Spanish (see point 7 of the FAQ ).
- Use separators (dots, spaces, dashes...) in the NIF of the notified.
- Manually write the footer of the announcement in the mandatory text block in Spanish without using the mark created for that purpose @@pieFirma@@ (see point 7 of the FAQ ) which collects the information entered in the footer field of signature (see point 15 of the FAQ ).
- Duplicate the signature footer in the mandatory text block in Spanish.
- Differences between the signature footer of the text block in Spanish and the signature footer of the text block in the co-official language. If you want to include a signature footer in this block, it must be done manually and with special care to reproduce exactly the same information included in the signature footer field in Spanish.
- Not saving the notified CSV file in UTF-8 encoding, which causes strange characters to appear (see the FAQ ).
- Do not check the box where it is informed that the announcement must be published according to the provisions of article 112 of Law 58/2003 (General Tax Law) when applicable (see point 4 of the FAQ ).
- Repeat an ad that has already been previously submitted to publish.
IMPORTANT : The BOE also publishes on its website a series of recommendations that must be taken into account in order to avoid the return of advertisements.
